First auto enrolment non-compliance notices issued by TPR

The Pensions Regulator (TPR) has issued its first formal notice to an unnamed company which has failed to fulfil its auto enrolment obligations. A further 38 less-severe warning letters have been sent to other businesses in the period to 12th August.

It was revealed last month that TPR were investigating 89 different incidents of possible non-compliance, focussing on larger companies which had already reached their staging date. These investigations and the warnings that followed are said to mainly relate to how prepared the employers were for auto enrolment and whether the correct communications were being sent out to employees.

A spokeswoman for TPR said "We plan to publish further detailed information around compliance and enforcement work. We will promote good compliance behaviour among employers by ensuring that the legislation is being applied fairly and that those who do not comply will face enforcement action in line with our risk based approach."
